In a previous post, I wrote about the Barrick v. Holy Spirit decision and its impact upon discovery of communications between attorneys and experts. To summarize, the superior court reached an 8-1 en banc decision holding that communications between a lawyer and an expert witness were not discoverable. After an appeal, the Supreme Court reached a 3-3 split decision on this issue, meaning that the superior court decision was still the law in Pennsylvania.

In a 4-2 vote, the Supreme Court of Pennsylvania has ruled that law enforcement may perform warrantless searches of motor vehicles without the existence of exigent circumstances. Now, the only prerequisite for a warrantless vehicle search is the existence of probable cause to search. Previously, there had to be both probable cause and exigent circumstances in order for law enforcement to perform such a search. With this decision, the Court has removed the additional privacy protection against unreasonable searches and seizures previously afforded to Pennsylvanians and has aligned the Commonwealth’s law with current federal law.

Joseph A. Cullen, Jr., Shareholder in Stark & Stark’s Accident and Personal Injury Group, was appointed to the Board of Directors of the Pennsylvania Convention Center Authority by the Bucks County Board of Commissioners on September 22, 2013. As a member of the Board of Directors, Mr. Cullen is a part of the leadership team responsible for the 14th largest convention facility in the country and approximately 250 events ranging from internationally attended conventions to regional company retreats. Mr. Cullen’s term will expire on December 31, 2016.
